“TRANSFORMERS: REVENGE OF THE FALLEN” COMPETITION
CONDITIONS OF ENTRY

1. Information on how to enter and prize details form part of these Conditions of Entry. Entry into the "Transformers: Revenge of the Fallen” Competition is deemed to be acceptance of these Conditions of Entry

2. The competition commences on 29th October 2009. Entries close at 11:59pm 1st November 2009.

3. Entry is only open to residents of Australia who are customers of EzyDVD (Eligible Entrants).  Employees and family members of the Promoter, agencies or companies associated with the Competition, including EzyDVD Pty Ltd, franchisees, are ineligible to enter.

4. Three prize packs are available. First prize is estimated value of $250 and consisits of 1 x Transformers Constructicon Devastator (Combiners). Second Prize is estimated value of $174.97 and consists of 1x Blu-ray Disc Starter Edition (Iron Man / Transformers / Shooter / Lara Croft: Tomb Raider / Tropic Thunder) (5 Disc Box Set). Third Prize is estimated value of $64.97 and consists of 1x Extreme Action Heroes: Ultimate Collection (Watchmen / Iron Man / Transformers / Incredible Hulk) (4 Disc Tin Set).

5. Prize value is correct at time of printing.  The sharing of a Prize is not permitted and the Prizes are not transferable, not exchangeable, cannot be taken for cash and are not valid with any other offer.

6. All prices stated are in Australian dollars, represent the recommended retail price (“RRP”) and include GST.  All references to times and dates are to times and dates in Sydney.

How to enter

7. To enter the Competition, an Eligible Entrant must log on to http://www.ezydvd.com.au/beatthebomb.zml and answer this question in 25 words or less ‘Tell us which Transfomer is your favourite and why?’

8. Eligible Entrant must purchase a copy of either Transformers: Revenge of the Fallen - Digital Copy Special Edition (Blu-ray), Transformers: Revenge of the Fallen - Limited Edition: Bumblebee Transforming Pack or Transformers: Revenge of the Fallen - Two-Disc Special Edition from EzyDVD.com.au, to enter and must complete all mandatory fields of the entry form in order to be eligible to receive a prize.

9. Eligible Entrants can enter multiple times.   Eligible Entrants can only win a maximum of one prize for the duration of the competition.

How winners will be determined:

10. This is a game of skill and chance plays no part in determining the winner.
11. A panel of judges will judge the creativeness of entries in answering the question.
12. The judges will determine the most creative entry and that entry will win the prize. 
13. The judges have absolute discretion in their determinations and their decisions are final.  No correspondence will be entered into.
14. The winners will be notified by mail, email or phone.
15. The Promoter may require an entrant to show that they are an Eligible Entrant.  Showing that an entrant is an Eligible Entrant may (in the Promoter’s sole discretion) include the Eligible Entrant providing, or showing to, the Promoter:

1. Proof of Australian residency; and
2. The Eligible Entrant’s is a customer of EzyDVD Pty Ltd.

16. In the event that any entrant does not claim his or her Prize or cannot show that he or she is an Eligible Entrant within 30 days of written notice being given to that entrant that his or her entry is a winner, the judges may reallocate the Prize to the next most creative entry that has not yet received a Prize.
17. No responsibility accepted for lost, late, stolen, damaged or misdirected mail.
18. If for any reason the Competition is not capable of running as planned, the Promoter reserves the right in its sole discretion to modify the terms of the Competition including the Prizes and these Conditions of Entry, subject to the approval (if required by law) of any relevant government authority.
19. The Promoter and the agencies and companies associated with the Competition will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a result of entering the Competition or receiving, accepting or using any prize except for any liability which cannot be excluded by law.
20. The Promoter and the agencies and companies associated with the Competition accept no responsibility for any tax implications that may arise from the prize winnings.  Independent financial advice should be sought.
21. The Promoter assumes no responsibility for:

1. Any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise;
2. Any theft, destruction or unauthorized access to, or alteration of such communications;
3. Any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Promotion;
4. Any incorrect or incomplete information which may be communicated in the course of the administering this Promotion.

CAUTION: Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.

22. If the winner of a Prize is under the age of 18 years, the Prize will be awarded to the winner’s parent or guardian.
23. If for any reason a prize is not available, the Promoter reserves the right to substitute it for another item, in its sole discretion, of an equal or greater recommended retail value.
24. All claims and entries become the property of EzyDVD Pty Ltd.  Each entrant agrees to do all things requested by EzyDVD Pty Ltd.  to ensure that the intellectual property rights in and to his or her entries become the property of the EzyDVD Pty Ltd and to provide all consents necessary or requested by the EzyDVD Pty Ltd   in relation to moral rights.
25. EzyDVD Pty Ltd may use the information an entrant provides for the purpose of conducting the Competition and in any media for further promotional, marketing and publicity purposes unless otherwise advised by the entrant.
26. EzyDVD Pty Ltd may disclose entrants’ personal information to its contractors and agents who assist it in conducting the Competition, communicating with entrants and conducting promotional, marketing and publicity activities.  EzyDVD Pty Ltd is bound by the National Privacy Principles in the Privacy Act 1988.
